                          RULES OF THE "WARM WITH ALTAI" COMPETITION

“WITH OUR FUEL YOU WARM UP TWICE – AT HOME AND ON HOLIDAY!
WIN A TRIP TO THE TROPICS!”

1. GENERAL PROVISIONS

1.1 The Organiser of the Competition is Maciej Wiliński, conducting business activity under the name AŁTAJ MACIEJ WILIŃSKI, entered into the Central Register and Information on Business Activity of the Republic of Poland, maintained by the minister responsible for the economy, with: business address and service address: ul. Wojciecha Kossaka 16, 22-100 Chełm, NIP 5632402540, REGON 361969490, e-mail address: sklep@altaj.com.pl, telephone number: +48 532 211 061.
1.2 The Competition is organised on the Organiser’s account on the Facebook social networking site, available at:  https://www.facebook.com/paliwastalealtaj.
1.3 Any Facebook user who expresses their willingness to participate by registering for the Competition in accordance with the Competition Rules may be a Participant in the Competition.
1.4 Providing information and data related to the Participant's participation in the Competition, including personal data, is voluntary; however, it may be necessary for the proper conduct of the Competition. Failure to provide the required information and data, including the personal data specified in the Rules and Regulations below, will prevent the Participant from participating in the Competition. Detailed information on the processing of the Participant's personal data is provided in point 5 of the Rules and Regulations.
1.5 The Participant may withdraw from participation at any time during the Competition by notifying the Organizer.
1.6 Definitions – terms used in the Rules and Regulations and beginning with a capital letter mean:
1.6.1 FACEBOOK – the Facebook.com social networking site available at: https://www.facebook.com/. This site is one of Meta's products provided to the user by Meta Platforms Ireland Limited in accordance with its terms and conditions available on the website.
1.6.2 ACCOUNT – the Organizer's page (profile) on Facebook available at: https://www.facebook.com/paliwastalealtaj  , maintained in accordance with the Facebook terms and conditions.
1.6.3 CIVIL CODE – the Civil Code Act of 23 April 1964 (Journal of Laws 1964 No. 16, item 93, as amended).
1.6.4 COMPETITION COMMITTEE – a committee appointed by the Organizer to ensure the proper organization and course of the Competition, in particular to assess the correctness of entries to the Competition and determine the winners of the Competition.
1.6.5 COMPETITION – this competition organized by the Organizer in accordance with the Regulations.
1.6.6 ORGANIZER / ADMINISTRATOR – Maciej Wiliński, conducting business activity under the name AŁTAJ MACIEJ WILIŃSKI, entered into the Central Register and Information on Business Activity of the Republic of Poland, maintained by the minister responsible for economy, with: business address and service address: ul. Wojciecha Kossaka 16, 22-100 Chełm, NIP 5632402540, REGON 361969490, e-mail address: sklep@altaj.com.pl, telephone number: +48 532 211 061.
1.6.7 COMPETITION POST – competition post published on the Facebook Account maintained by the Organizer, enabling participation in the Competition on the terms described in these Regulations.
1.6.8 REGULATIONS – these Competition rules.
1.6.9 PARTICIPANT – an adult natural person with full legal capacity, who participates in the Competition and additionally meets the requirements specified in point 2 of the Competition Rules.
1.6.10 COMPETITION TASK – the Participant's competition task consisting of: purchasing one full pallet of a heating product (960 kg, 975 kg or 1000 kg, depending on the product type) from the Organizer, posting a photo using the purchased products, showing a warm interior or the purchased products next to a stove, under the Competition Post under the Organizer's competition post on Facebook, and correctly tagging the photo with the hashtag: #OgrzewajzAltajem. Detailed terms of the Competition Task are specified later in these Rules.
1.7 The name "Facebook" is a trademark registered by Meta Platforms, Inc.
1.8 The Organizer informs that the Competition is in no way or scope sponsored, endorsed, conducted, administered, affiliated with, or associated with Facebook. If, under Polish law, Facebook (Meta Platforms Ireland Limited, Meta Platforms, Inc.) is liable for the execution of the Contest in a manner that cannot be excluded by the provisions of these Rules, Participants may direct their claims to the Organizer as the entity guaranteeing the proper execution of the Contest.
1.9 Facebook is a product of Meta and is provided to users by Meta Platforms Ireland Limited. Use of Facebook is governed by separate terms and conditions, which are available on its website: https://pl-pl.facebook.com/help/Facebook/581066165581870.

2. CONDITIONS OF PARTICIPATION IN THE COMPETITION
2.1 Participation in the Competition is voluntary.
2.2 The Competition is organized on the Organizer's Account. On the day the Competition begins, the Organizer will publish a Competition Post on the Account informing about the Competition, inviting participants to participate, listing the prizes available in the Competition, and announcing the end date. No later than on the day the Competition begins, the Organizer will also publish the Rules on the Account.
2.3 The conditions for participation in the Competition are:
2.3.1 having a public account (profile) on Facebook;
2.3.2 reading the following Rules before entering the Competition;
2.3.3 completing and submitting the Competition Task during the Competition in accordance with the Rules.
2.4 The Competition Task involves completing all of the following steps:
2.4.1 purchasing one full pallet of heating product (1mp, 1.7mp, 960 kg, 975 kg or 1000 kg, depending on the product type) from the Organizer.
2.4.2 posting a photo using the purchased products, showing a warm interior or the purchased products next to a stove, under the Competition Post under the Organizer's Facebook competition post. 2.4.3
correctly tagging the photo post with the hashtag: #OgrzewajzAltajem.
2.5 To increase the chance of winning the Competition, the Participant may complete the Competition Task multiple times during the Competition period, with the proviso that a maximum of one prize may be awarded to one Participant in the Competition, regardless of the number of Competition Tasks submitted.
2.6 The publication specified in point 2.4.2 should be made available at least until the Competition results are announced by the Competition Jury. If a Participant removes a Competition Entry before this date, it will not be considered for selection and announcement of the winning Competition Task.
2.7 The Competition Task must be created independently by the Participant and must be their own work that has not been previously published, including on the Internet. By completing and submitting a Competition Task to the Organizer, the Participant is obligated to hold full personal and property rights to it.
2.8 Participants, particularly in connection with the completion and submission of the Competition Task, are prohibited from submitting unlawful content. Content provided by the Participant, particularly as part of the Contest Task, must comply with these Terms and Conditions and the Facebook Terms and Conditions, and must be lawful and in accordance with good practice, respecting the personal rights, copyrights, and intellectual property of the Organizer, entities, and third parties. It must also not contain any images, sounds, or language that is generally considered offensive, abusive, vulgar, or violating the rules of social coexistence, as well as any pornographic content, content promoting racial, ethnic, or religious hatred, or content discriminating against any groups or individuals. Furthermore, the information provided by the Participant in connection with participation in the Contest must be authentic, factually accurate, and not misleading.
2.9 The Participant's actions in the Contest must not violate the Facebook Terms and Conditions (the terms and conditions are available on the website: https://pl-pl.facebook.com/help/Facebook/581066165581870).
2.10 Employees and associates of the Organizer and other individuals involved in preparing or organizing the Competition, as well as members of their immediate families, are excluded from participating in the Competition. Immediate family members include: ascendants, descendants, siblings, spouses, spouses' parents, and persons in an adoptive relationship.

3. CONDITIONS AND RULES OF THE COMPETITION, ANNOUNCEMENT OF WINNERS
3.1 The Competition is open to all participants who purchased a full pallet of fuel from September 1, 2024 to March 10, 2025, and competition tasks can be submitted from January 27, 2025, from 00:01 to March 10, 2025, 23:59 Polish time.
3.2 In order to select the winners of the Competition and ensure the proper conduct of the Competition, the Organizer has appointed a Competition Jury consisting of three persons. The Competition Jury will freely select the winning Competition Tasks, using its own discretion, taking into account appropriateness, compliance with the Competition theme, originality, creativity and artistic value, as well as naturalness (i.e. minimal use of filters and image processing) of the Participant's Competition Task.
3.3 Winners will be selected in the Competition and awarded the following prizes:
3.3.1 Place 1:A holiday trip for two to the Dominican Republic.
3.3.2 Place 2:A discount of a total value of PLN 1,000 when purchasing 5 full pallets (PLN 200 discount per pallet).
3.3.3 Place 3:A discount of a total value of PLN 800 when purchasing 4 full pallets (PLN 200 discount per pallet).
3.3.4 Place 4:A discount of a total value of PLN 600 when purchasing 3 full pallets (PLN 200 discount per pallet).
3.3.5 Place 5:A discount of a total value of PLN 400 when purchasing 2 full pallets (PLN 200 discount per pallet).
3.3.6 Place 6:A discount of a total value of PLN 200 when purchasing 1 full pallet (PLN 200 discount per pallet).
3.4 The Contest results will be announced within 7 calendar days of the Contest end date by publishing information about the winners (profile name) on the Organizer's Facebook account. Additionally, the Organizer will inform the winners via private messages via Facebook.
3.5 The winner is obligated to provide the Organizer with the information necessary to deliver the prize (name and surname, email address, and shipping address) within 14 calendar days of the Contest results announcement. If any information is missing, the Organizer may request that the Participant provide it. The condition for awarding the prize is to send all necessary information within the above-mentioned deadline to the Organizer's email address: sklep@altaj.com.pl.
3.6 The winner may waive their right to win the prize, but may not transfer the right to the prize to a third party or request that the prize be exchanged for a cash equivalent or any other form of compensation.
4. COPYRIGHT TO COMPETITION TASKS (LICENSE)
4.1 In relation to the winning Competition Task, to the extent permitted by law, the Organizer acquires from the Competition Participant a non-exclusive and transferable license (including the right to sub-license it to the extent specified below) to all works included in the Competition Task, without any time, quantitative or territorial limits, i.e. in the following fields of exploitation: permanent or temporary copying, duplication, reproduction, entering into computer memory, IT and telecommunications systems, in whole or in part, by any means and in any form (in particular on the Internet, press, television, radio or other mass media, regardless of the carrier); translation, adaptation, rearrangement or any other changes, editing, modifications and alterations to the work, including its incorporation into other works, without the need to obtain additional permission to distribute the work resulting from such changes (dependent rights); as well as the right to public distribution, performance, exhibition, display, reproduction, broadcasting, or transmission, including on television, radio, in the press, on the Internet, on the Organizer's websites and social media profiles, as well as any use of the work submitted as part of the Competition Task for the Organizer's promotional, marketing, and advertising purposes, by any means and in any form, in particular using digital, reprographic, and printing techniques, and making it publicly available in such a way that everyone has access to it at a place and time of their choosing.
4.2 The above license also includes the Participant's permission to use and distribute their Competition Task, in whole or in part, by the Organizer without the requirement to indicate the Participant's authorship (name, surname, etc.).
The prize awarded for the Competition Task includes remuneration for granting the Organizer all consents and permissions specified in points 4.1–4.2 above, including the license to use the work.
4.3 With respect to the winning Competition Task, to the extent permitted by law, the Participant is obligated to enter into an agreement with the Organizer, within the scope indicated in point 4.1, on the transfer of copyright and refraining from exercising personal property rights. The prize awarded for the Competition Task includes the remuneration specified in the first sentence of this point (agreement on the transfer of copyright and refraining from exercising personal property rights).
5.PRIVACY POLICY
5.1 The Organizer is the controller of personal data processed in connection with the implementation of the provisions of these Regulations. Personal data are processed in accordance with applicable law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as "GDPR" or "GDPR Regulation". 5.2 The Administrator processes personal data for the purposes, for the period and based on the principles indicated in this section of the Terms and Conditions. Providing personal data is voluntary, however, failure to provide the personal data required to participate in the Contest will result in your inability to participate.
5.3 Pursuant to the GDPR, the Controller is entitled to process personal data in cases where – and to the extent that – at least one of the following conditions is met: (1) the data subject has consented to the processing of his or her personal data for one or more specific purposes; (2) processing is necessary for the conclusion of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract; (3) processing is necessary for compliance with a legal obligation to which the Controller is subject; or (4) processing is necessary for the purposes of the legitimate interests pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, in particular where the data subject is a child.
5.4 The processing of personal data by the Controller always requires the existence of at least one of the grounds indicated above. The specific basis for processing Participants' personal data by the Administrator is indicated in the next section of the Regulations – in relation to the specific purpose of personal data processing by the Administrator.
5.5 The Administrator may process personal data for the following purposes, on the following legal basis, and for the following periods:

Data is stored for a period of one year.

The controller may not process data for direct marketing purposes in the event of an effective objection in this respect by the data subject.

Determining, pursuing or defending claims that may be raised by the Administrator or that may be raised against the AdministratorArticle 6(1)(f) of the GDPR Regulation (legitimate interest) – processing is necessary for the purposes of the legitimate interests of the Controller – consisting in establishing, pursuing or defending claims that may be raised by the Controller or that may be raised against the Controller in connection with the ContestThe data is stored for the duration of the legitimate interest pursued by the Controller, but no longer than the limitation period for claims that may be brought against the Controller (the basic limitation period for claims against the Controller is six years).

4.6 When organizing the Contest, the Controller must use the services of external entities. The Controller only uses the services of processors who provide sufficient guarantees to implement appropriate technical and organizational measures so that the processing meets the requirements of the GDPR and protects the rights of data subjects. The Controller only transfers data when it is necessary to achieve a given personal data processing purpose and only to the extent necessary to achieve it. Participants' personal data may be transferred to the following recipients or categories of recipients:
4.6.1 service providers supplying the Controller with technical, IT, and organizational solutions enabling the Controller to conduct its business (in particular, computer software providers, email and hosting providers, and software providers for managing business and providing technical support to the Controller) – the Controller shares the collected personal data of Participants with a selected supplier acting on its behalf only when and to the extent necessary to achieve a given data processing purpose in accordance with this point 4 of the Regulations.
4.6.2 providers of accounting, legal, and advisory services providing the Controller with accounting, legal, or advisory support (in particular accounting offices, tax advisors, or law firms) – the Controller makes the collected personal data of the Participant available to the selected provider acting on its behalf only in the case and to the extent necessary to achieve a given purpose of data processing in accordance with this point 4 of the Regulations.
4.7 The data subject has the following rights:
4.7.1 Right of access, rectification, restriction, erasure, or transfer – the data subject has the right to request from the Controller access to their personal data, its rectification, erasure ("right to be forgotten"), or restriction of processing, and has the right to object to processing, as well as the right to transfer their data. Detailed conditions for the exercise of the above-mentioned rights are specified in Articles 15-21 of the GDPR.
4.7.2 Right to withdraw consent at any time – a person whose data is processed by the Controller on the basis of expressed consent (pursuant to art. 6 sec. 1 letter a) or art. 9 sec. 2 letter a) of the GDPR) has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
4.7.3 Right to lodge a complaint with a supervisory authority – a person whose data is processed by the Controller has the right to lodge a complaint with a supervisory authority in the manner and procedure specified in the provisions of the GDPR Regulation and Polish law, in particular the Personal Data Protection Act. The supervisory authority in Poland is the President of the Office for Personal Data Protection.
4.7.4 Right to object – a data subject has the right to object at any time – on grounds relating to their particular situation – to the processing of personal data concerning them based on art. 6 sec. 1 letter a). e) (public interest or tasks) or f) (legitimate interest of the controller), including profiling based on these provisions. In such a case, the Controller is no longer permitted to process these personal data unless they demonstrate compelling legitimate grounds for processing that override the interests, rights, and freedoms of the data subject, or grounds for establishing, pursuing, or defending legal claims.
4.7.5 Right to object to direct marketing – if personal data are processed for direct marketing purposes, the data subject has the right to object at any time to the processing of their personal data for such marketing purposes, including profiling, to the extent that the processing is related to such direct marketing.
4.8 In order to exercise the rights referred to in the above section of the Regulations, you can contact the Controller by sending an appropriate message in writing or by email to the Controller's address indicated at the beginning of the Regulations.
6.COMPLAINTS PROCEDURE
6.1 Complaints related to the Competition may be submitted by the Participant, for example, via email to the following address: sklep@altaj.com.pl or in writing to the Organizer's address: ul. Wojciecha Kossaka 16, 22-100 Chełm.
6.2 It is recommended to provide as much information and circumstances concerning the subject of the complaint as possible in the complaint description, in particular the type and date of the irregularity and contact details – this will facilitate and expedite the Organizer's consideration of the complaint. The requirements specified in the preceding sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended complaint description.
6.3 The complainant may attach evidence (e.g., photos, documents) related to the subject of the complaint to the complaint. The Organizer may also request the complainant to provide additional information or send evidence (e.g., photos) if this will facilitate and expedite the Organizer's consideration of the complaint.
6.4 The Organizer will respond to complaints immediately, no later than within 14 days from the date of submission of the complaint.
6.5 The principles for reporting and processing complaints specified in the Regulations do not in any way limit the Participant's right to file a claim with a competent common court in accordance with applicable law.
6.6 The consumer has the following examples of out-of-court complaint and claim settlement options: (1) a request for dispute resolution to a permanent consumer arbitration court; (2) a request for out-of-court dispute resolution to the provincial inspector of the Inspection; or (3) assistance from a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., the Consumer Federation, the Association of Polish Consumers). Advice is provided, among others, by email at porad@dlakonsumentow.pl and by calling the consumer hotline at 801 440 220 (the hotline is open on business days, from 8:00 a.m. to 6:00 p.m., call charges apply).
6.7 A platform for online dispute resolution between consumers and traders at EU level (ODR platform) is available at http://ec.europa.eu/odr. The ODR platform is an interactive and multilingual website with a comprehensive service point for consumers and entrepreneurs seeking out-of-court resolution of a dispute concerning contractual obligations arising from an online sales contract or a service contract (more information on the website of the platform itself or on the website of the Office of Competition and Consumer Protection: https://polubowne.uokik.gov.pl/platforma-odr,161,pl.html
7. FINAL PROVISIONS
7.1 The law applicable to the organisation of the Competition is Polish law.
7.2 The Organiser declares that the Competition is not a game of chance, a raffle, a mutual bet, a promotional lottery, a game whose outcome depends on chance, or any other form subject to the provisions of the Gambling Act of 19 November 2009 (Journal of Laws of 2009, No. 09, item 1540, as amended).
7.3 In matters not regulated in these Regulations, the provisions of the Code of Civil and other relevant provisions of Polish law.
